JMS Menu Marketing and/or Kids Play Spot, LLC does not warrant the correctness or accuracy of the content contained herein.

Like all Web site services, JMS Menu Marketing may be temporarily unavailable from time to time due to required maintenance, telecommunications interruptions, or other disruptions. Although JMS Menu Marketing makes every reasonable effort to minimize such downtime, JMS Menu Marketing does not guarantee 100 % availability of its services. JMS Menu Marketing will not be liable for any damages due to causes beyond its reasonable control, including but not limited to: acts of G-d, fire, war, natural disaster, accident, riots, acts of government, shortage of materials or supplies, failure of any transportation or communication system, non-performance of any of the Customer's computers or third party providers (including, without limitation, the failure or performance of common carriers, interchanged carriers, local exchange carriers, internet service providers, suppliers, subcontractors) or any other cause beyond its reasonable control.

Under no circumstances will JMS Menu Marketing be liable for the contents or value of the Customer's lost or damaged data. Furthermore, JMS Menu Marketing will not be liable for incidental or consequential damages even if it is advised of the possibility thereof. This limitation of JMS Menu Marketing liability will apply regardless of the form of action, whether in contract or tort (including negligence). Customer warrants that it is the owner or legal custodian of the data transmitted to JMS Menu Marketing and that it has full authority to transmit said data to its designated party for downloading purposes.

JMS Menu Marketing offers no refunds under any circumstances.
